    Well, even the traffic/speeing violation may become a crime. It just depends on how many times you keep doing it !

    I am sorry stucklabour but a traffic/speeding violation is a misdemeanour and not breaking the law. Being in this country illegally is actually breaking the law. Now i am not going to get suckered into a whole legals v/s illegals debate, but at some level i do feel that undocumented workers HAVE broken the law. Besides the argument that "everyone does it" really doesnt cut it. 10 wrongs do not make 1 right. If you look at the punishment for the 2 things a speeding violation leads to a simple fine, a violation of Visa leads to deportation.

    Now i personally dont care, whether the US Govt asks the undocumented to stay or leave. What i DO care about is, how we, the legals are treated. So whether the illegals are mexican, indian, chinese, cambodian or actual aliens from Mars, the policy should be: "If you come the right way, you will make it in, if you come the wrong way, you will either NOT make it in at all, OR will have to wait much longer than the people who came in the right way". So poeple pls stop the "racist" remarks against Just the Mexican community and culture. On the other hand the moderators too have to understand that everyone here does have a right to express SOME opinions regarding the undocumented/illegal immigrants. When you see urself and people doing things the right way waiting for years, as opposed to people doing things the wrong way being literally gifted Green cards, it does raise anger and frustration levels.

    I think it depends on who the primary applicant is in your Canadian PR application. If you are the primary applicant (and used your spouce's qualifications to get the extra points), you should be able to do the landing alone. But if you are the secondary applicant and your wife is the primary then I don't think you can land without her.

    I think the rule is that the secondary applicants cannot land until the primary applicant has landed. (So the secondary applicants (spouce, kids) have to land either with the primary applicant or after him.


    Last week i received a letter from my canadian lawyer to send my passport to buffalo for stamping. The last date mentioned is March,08

    Regarding me, I got through canadian immigration with mine and my wife's points. My wife is a Permanent resident for last 3 years 10 months in US. I am in EB3 category. PD Oct 06.

    When checked the rules for maintaining PR in US for my wife, She cannot apply for PR in any other country till the time she is a PR in this country. As per the lawyers she will have a difficulty in applying for citizenship.

    Now, I cannot myself apply for canadian immigration. because its a joint filing. What should i do?

    Got receipt notice for I-485/AP/EAD/ from USCIS today (8/30/2007). My package was delivered to Nebraska center on July/27/2007. Notice date is August 21st, 2007. My priority date is Dec/23rd/2003.

    probably Texas, that is where my I-140 was approved.


    Cancelled 4 tickets and lost 1000 bucks. Was to fly on 6th. Never expected dates will move. MY PD Nov 2001 EB3 India.

    Hoping to get receipts by 20th. Is that a fair assumption? Planning to re-book for 22nd.

    Don't want to lose another dime on cancellations and re-bookings.

    Advice and share your thoughts.

    Mine reached Texas at July 3rd 9-30 a.m. it was mailed on JUNE 30th via DHL for next day delivery but as per DHL they had routing discrepancy (or my bad luck) and they delivered it on JULY 3rd instead of JULY 2nd..any one out there with JULY 3rd delivery..any updates for them..

    If you are consulting and not getting bench period salary, try to be out of project for some time and ask him to pay for that period. According to H1B he supposed to pay the salary. Probably at that point he has to let you go.

    Unfortunately no community is safe from that irrational attacks of racism!
    If you turn on your Hispanic TV networks , nowadays lots of Mexicans are
    blaming Argentinian coach/ naturalized players on Football World Cup elimination!
    Lots of them are demanding that non mexican born people are not allowed neither to coach nor to play for Mexico anymore!:eek:

    Generalizations are dangerous, for your information it is not racism, the fear of foreigners is known as Xenophobia. Argentines are not that much different from persons from Mexico as to their ethnicity and racial composition. Secondly the views of a few angry callers should not get a country labelled for a social ill just as the minute men and some supremacist groups do not make the US predominantly racist. We're loosing the focus here, this is not about this country or that country its about the immigrant community and the challenges we collectively face.

    Firstly let me say that the Dems taking the house is the only hope I see for change near term. If the Republicans take it then they will feel vindicated on their stand and stick to it especially in view of the current unpopularity of Pres. Bush.

    Democrats normally sing the tune of organised labour on such issues. Organised labour is clear that they want the immigrants that come not to be exploited. In otherwords, if you let them come then treat them well as they are now part of the labour pool. This idea has some intrinsic merit. If you analyse things, it is usually during the long drawn out protracted green card process that unscrupulous employers take the most advantage.

    Indeed the deluge of illegals will be a blight on the processing times, however without visa numbers there is absolutely no hope for EB India in the near term anyway. We have to hope for the lesser of two evils now.

    Sen Byron Dorgan is always on Lou Dobbs show. He does not represent the majority view of the democratic party. I think he is making all sorts of noises to fight for his political life.

    yes ..I agree with most of the above. the new admin is more protectionist .. I wonder if the analysis will show that a large number of immigrant visas were wasted !!!
    in republicans you have 20% against immi but democrats maybe 80% against
    hopefully BJP will come to power in India and retaliate against nuclear deal ..and then they will realise that protectionism cuts both ways !!

    If skill bill is passed in the same form as it is Americans will be alarmed seeing the inflow based on exemption of US based Master degree and STEM. Not only to Americans it is threat for current H1s and green card holders as well. The problem is those who have money in India can get admission in USA MS degree in any non standard college(I do not think INS can evaluate whether it is standard or not). So atleast 4 times of current MS students will come and they will get h1(I think Ms people has exemption in quota) thro Desi consultants by paying Money and get green card immeditely. This will defeat the purpose of skill bill itself. And also India so many people are doing MSC they can get gc easily here(As we know Indians or anyone will use loopholes to come here and get gc). If immigration is increased so much then it will impact all kinds of exsisting people. I think there should be control in number of h1s and also green cards. I am clear that both H1 and green card numbers should be increased but blanket exemption should not be given any category especially for H1. There were a situation on 2000 and 2001 lot of people returned India because of too much supply and Americans were angry with immigrants at that time especially H1 because they were laid off.

    So basically increase of immigration should be based on supply and demand . The purpose of Labour certification is to verify whether any american is rejected for that job. But that is now just formal and real test is not done(it is not possible to do it. If they do it it will take years to clear). I think if they double number of gcs the retrogession issue will be resolved for atleast another 5 years

    Correct me If I am wrong

    out of 45K members let's assume 22.5 K are EB2 and 22.5 K are EB3.

    Even If 11.25K (EB2)+11.25K (EB3) = 22.5 K (Total) contributes $25 Each Problems gets solved ... but the catch is ....

    Even 11.25 K EB2 members are not contributing because they don't have to as their problem is solved

    Even 11.25 K EB3 members are not contributing because they are not sure even with this contribution their problems gets solved.

    Many people are saying that EB3 members are not contributing that's why you are lagging etc...

    EB3 Members who contributed are feeling the pain because even after contribution they are not getting the results and EB2 members who didn't contributed are getting the results...

    Let's assume EB3 at 11.25K. They all know that their are royally screwed unless there is legislative action. So, I would expect 11.25 K EB3 to be at the front of this funding drive. Let's face it EB2 will likely become current sometime in 2012 (per Q and Teddy in other thread), no one is ever predicting this to happen for EB3 barring law change. IF you are in such a big hole, you will have to come forward and work for yourself. We want others to work for us and solve our problems. That is my issue here. With 11.25 K EB3 members we would have still collected quarter million bucks.(@ 25$/person) If EB3-I does not care for itself, why would anybody else give a damn? (PS : I did contribute for the drive as I want everybody's issues with respect to GC resolved, not just mine)

    So, the original post still stands true.

    You can view my past posts in IV, I am not Desi employer but I may become very soon to employ myself (very close to get GC :-) )

    Anyway have you gone through yourself with same situation/tension as OP going through or do you know someone closely who have gone through? Have you dealt with attorney yourself?


    If that employer sue you, definitely you can counter sue for violation of wage related or h1b related rules and attorney will be the best person to advice you on that. make sure you go to an attorney who practice employement laws and have knowledge or have some other attorney in the same firm who deals in immi related matter. But question is, do you want to go through nightmare of law suites or you just want peace of mind.

    Your suggestion of talking to an attorney is well taken but not the advices. Thanks, good luck in your business

    The plan that mirage is talking about is to contact only the lawmakers who are already well versed with immigration.


    Now; senators/congressmen who don't have much knowledge and you present to them why the country quota, etc., should be changed; will be given evidence through their research of what is going on with h-1b, labors in fast procesing states, etc., In this environment where there is sentiment against immigration it will fall on deaf ears and maybe even skew things in the future for you with the politicians because they are getting insight into this stuff at the wrong time.
