This is not correct from legal point of view. I would put this statement as
-- Must have valid work authorization. Sponsorship for any work visa is not offered.
Employer can not ask for kind of authorization. It could be, EAD, OPT, GC etc. As long as applicant is qualified as per I-9 form, kind of authorization should not matter.
Of course, H-1B applicant can not apply for this job position since visa sponsorship is not available.

I am waiting for FP .Even I have called TSC having intention to open SR ,i got the reply all files are up to date and they can not open SR for FP ...Files indicate that FP is complete.(God knows what they mean,whose fingerprint they have on my file) ....I have not given any FP so far except at the PORT of entry .

I'm so thrilled that this happened ... I actually expected this to happen ........ Not sure why they didnt simply make it U .... Hopefully will spur all the EB2 folks to do something rather than thinking that the problem is only for unfortunate EB3 filers :)

what is this analogy none sense..... u'r a disgrace to eb2...... date porting is codified in the law..... no one can change it but congress....... the problem with congress is that it cannot agree with anything related to immigration...... let's say they decide to do just one thing, just one....... do u truly believe that anybody other than u on this planet would care to stop porting of eligible applicants to eb2?...... pls keep me posted if you send out any communication to anyone for stopping porting.... becoz i'll send double the number of emails and letters to keep porting in place.....

Under the circumstances we might like to approach the Hon'ble President by posting a well drafted letter (not more than a page). Let us see what happens. All letters should be posted withing a specific pre-determined time frame (within one week, say from June 1 to June 7) to create an impact. We might like to achieve a target of say 250,000 letters. This cannot go unnoticed.
The law suit option is not bad but probably would need serious consideration. The suit will have more impact if we first send the letter. Atleast then we will have a point in our favour - that we have been driven to wall with no option but to fight legally.
As a starting point can some of us come up with some convincing drafts? We could eventually come up with a good final draft.
Obama was the only person who did make a mention of the problems faced the legal immigrant community during the campaign. We need to highlight this too.

I see your point, time is of essence. Send as many letters as soon as possible.

100% correct. I guess its human. If you did not file for 485 in Jul 07, people want to file when PD is not current. For people who filed and are waiting, want the backlog cleared. People who have GC are "worried" about getting citizenship :). People who just came in, are worried about they PERM/140 approvals.

I think the substituters were the smart ones (though a few of them were burned during the process). I guess, people like you and I choose to follow the safe route.

Mine is a labor substitution case. Labor PD: 02/2007. I-140 filed on 06/29/2007 in NSC and received the case number and also notice of action (I-797). If it is not a labor substitution case, then it would have been filed in TSC.
I live in Texas and my attorney filed I-1485 in TSC on 08/02/2007.
Whether my I-140 (based on labor substitution) will be transferred to TSC, from NSC? Or my I-485 will be transferred from TSC to NSC? How this transfer of cases from one center to another happening?

Is there any way we can work for our US employer from India on Indian salary? ......................... So we will just be living in India and working remotely for the employer as a consultant. We will be paying indian taxes as the consulting company will be indian. Any thoughts?

last week i took infopass and got shedule for biometric , i am also july 2nd filler and had not receive appointment until last week.
my appointment actually at 28th may 2008 but yesterday i went to asc and told them i will be leaving usa next week and request to take biometric fineally i am able to get biometric yesterday.
but i have to pay $25 for him doing my fevour because with out that he isnot willing to do so.
there is no lud today on my i-485 so could you please tell me how long it take to get lud ?
how long it take to clear fbi?
what is soft lud and hard lud ?
my pd is current so will i soon see my i-485 processing ?

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

My husband's coworker s from his first/second employers who came during same time are close to get citizenship. If my husband wouldn't have switched his jobs for his carrier advancements and salary then we also would have applied for citizenship by now. But we don't regret our decision at all. We feel sad sometimes but depressed by not getting GC by now, instead we spend that energy in advancement of our skills and carrier. We have many people among our friend circle who are waiting for GC for many years but we decided to enjoy our life as much as we can and not to bring any GC related depression in our life. If you have such friends among you then it becomes very easy to get out of this depression.
